I am requesting the letters of intent from AT&T, Axia, Foresite, Network Design Decision, Open Broadband, Rapidity, Sunset Digital Communications, Terra Pact, Ting, Wide Open Networks, Wilkes TMC and Fujitsu/NDDI, and three undisclosed respondents of the city’s RFP related to Fibrant.
In addition, I am requesting the proposals to buy, lease, or manage Fibrant from AT&T, Fujitsu, Rapidity/Terrapack, and the three undisclosed respondents of the city’s RFP related to Fibrant that submitted proposals that will be reviewed next Wednesday by an appointed committee.
I am requesting these documents by noon Monday. I know they are readily accessible and will not take more than a few minutes to scan and email to me.
Let me be clear. City Manager Lane Bailey’s public explanation that these documents are exempt from public records laws due to them falling under the economic development exemption is an incorrect and manipulative interpretation of the statute.
The sale or lease of one of the city’s largest alleged assets, and all documents related to, are a clear matter of public record under the general statutes. A proposal to manage one of the city’s largest assets is also a clear matter of public record under the general statues. Hiding behind an incorrect and manipulative interpretation of the economic development exemption to momentarily delay the release of such documents until after a decision has been made, precludes the public from weighing in on the decision making process related to the future of an asset that we all own as citizens.
Failure to provide these documents by noon Monday will result in my consideration of legal action and an injunction. It’s costs me $50 to file to provide the citizens of this city with the transparency you should be doing in the first place as public servants.
